Terms and Conditions for Tiger Safari Trails

Welcome to Tiger Safari Trails! These Terms and Conditions ("Terms") govern your access to and use of the Tiger Safari Trails website and services (collectively, the "Platform") which connects users with third-party Tiger Safari Operators ("Operators").

By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy (which is incorporated herein by reference). If you do not agree to these Terms, you must not access or use our Platform.

1. Description of Service

Tiger Safari Trails is an online platform that acts as a directory and information service, helping users discover and connect with independent third-party Tiger Safari Operators. We facilitate the sharing of your inquiries with these Operators. We do not own, operate, manage, or control any safari services, nor do we act as an agent for users or Operators in any capacity, other than to facilitate this initial connection.

2. User Eligibility

By using our Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Use of the Platform

• Permitted Use: You agree to use the Platform only for lawful purposes and in accordance with these Terms, primarily to find information about Tiger Safari Operators and to facilitate contact with them.
• User Account (if applicable): If we offer user account creation, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Communication with Operators: When we facilitate contact by sharing your inquiry (made via our website, WhatsApp, or email) with Operators, your subsequent interactions, including any bookings or financial transactions, are solely between you and the Operator.
• Prohibited Conduct: You agree not to:
  • Use the Platform for any illegal or unauthorized purpose.
  • Submit false, misleading, or inaccurate information.
  • Harass, abuse, or harm another person or entity, including Operators or other users.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Attempt to gain unauthorized access to the Platform or its related systems or networks.
  • Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Platform in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional on-line web browser.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without our express written permission.

4. Role of Tiger Safari Trails and Relationship with Operators

• Connector Platform: Tiger Safari Trails is solely a platform to connect Users with Operators. We do not endorse any particular Operator or guarantee the quality, safety, legality, or availability of their services.
• No Bookings or Payments: Tiger Safari Trails does not process bookings or collect any payments for safari services. All bookings and payments are handled directly between you and the Operator. We are not a party to any agreement or transaction you enter into with an Operator.
• Operator Information: Information about Operators and their safari packages listed on our Platform is provided by the Operators themselves. While we encourage Operators to provide accurate and up-to-date information, we do not verify, guarantee, or take responsibility for the accuracy, completeness, or timeliness of such information. It is the sole responsibility of the Operator to ensure their listed information is correct.
• Independent Entities: Operators are independent third parties and are not employees, agents, partners, or joint venturers of Tiger Safari Trails.

5. Intellectual Property Rights

All content and materials on the Platform, including but not limited to text, graphics, website design, logos, icons, images, audio clips, video clips, data compilations, and software, and the collection, arrangement, and assembly thereof (collectively, "Our Content"), are the exclusive property of Tiger Safari Trails or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of Our Content without our prior written consent.

6. User-Generated Content (if applicable)

If the Platform allows users to post content, such as reviews or feedback ("User Content"):

• You grant Tiger Safari Trails a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.
• You represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; that use of the User Content you supply does not violate these Terms or our Privacy Policy and will not cause injury to any person or entity; and that you will indemnify Tiger Safari Trails for all claims resulting from User Content you supply.
• We have the right but not the obligation to monitor and edit or remove any User Content. We take no responsibility and assume no liability for any User Content posted by you or any third party.

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, TIGER SAFARI TRAILS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

TIGER SAFARI TRAILS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION OR SERVICES OBTAINED THROUGH THE PLATFORM, INCLUDING ANY INFORMATION PROVIDED BY OPERATORS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIGER SAFARI TRAILS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF TIGER SAFARI TRAILS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING WITHOUT LIMITATION, ANY OPERATOR;
• ANY INFORMATION OR SERVICES PROVIDED BY OPERATORS, INCLUDING THE ACCURACY OF SUCH INFORMATION, THE QUALITY OF SAFARIS, SAFETY, OR ANY DISPUTES, SCAMS, OR ISSUES ARISING FROM YOUR INTERACTIONS OR TRANSACTIONS WITH OPERATORS;
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN;
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR PLATFORM BY ANY THIRD PARTY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED ONE HUNDRED INDIAN RUPEES (INR 100).

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF TIGER SAFARI TRAILS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tiger Safari Trails, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, any use of the Platform's content, services, and products other than as expressly authorized in these Terms, or your interactions or transactions with any Operator.

11. Third-Party Links

The Platform may contain links to third-party websites or resources, including those of Operators. These links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to this Platform, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

12. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice (e.g., by posting a notice on our website or sending an email to registered users) prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Platform.

13. Governing Law and Dispute Resolution

The arbitration shall be administered pursuant to the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, Maharashtra, India. The language of the arbitration shall be English. The arbitrator's award shall be final and binding on the parties.

14. Termination

We may terminate or suspend your access to all or part of the Platform, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

16. Waiver

No waiver by Tiger Safari Trails of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Tiger Safari Trails to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Tiger Safari Trails regarding the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.
